161. The amount up to which a pipeline construction or use authorization holder is liable for the purposes of the no-fault liability regime, in the case of a pipeline used for gathering and transporting oil is
(1)  where it is located on land,
(a)  $10,000,000 for a pipeline whose design capacity is less than 5,000 barrels per day;
(b)  $25,000,000 for a pipeline whose design capacity is between 5,000 and 14,999 barrels per day;
(c)  $50,000,000 for a pipeline whose design capacity is between 15,000 and 29,999 barrels per day;
(d)  $200,000,000 for a pipeline whose design capacity is between 30,000 and 49,999 barrels per day;
(e)  $300,000,000 for a pipeline whose design capacity is between 50,000 and 250,000 barrels per day; and
(f)  $1,000,000,000 for a pipeline whose design capacity is greater than 250,000 barrels per day; and
(2)  where it is located in a body of water,
(a)  $25,000,000 for a pipeline whose design capacity is less than 5,000 barrels per day;
(b)  $40,000,000 for a pipeline whose design capacity is between 5,000 and 14,999 barrels per day;
(c)  $75,000,000 for a pipeline whose design capacity is between 15,000 and 29,999 barrels per day;
(d)  $200,000,000 for a pipeline whose design capacity is between 30,000 and 49,999 barrels per day;
(e)  $300,000,000 for a pipeline whose design capacity is between 50,000 and 250,000 barrels per day; and
(f)  $1,000,000,000 for a pipeline whose design capacity is greater than 250,000 barrels per day or where it is located in a lake whose area is greater than 1,000 km2 or in a marine environment.
